These Candidate Terms apply to every candidate who uses the 24werk.com platform. These Candidate Terms supplement the Terms and Conditions of 24werk.com. In the event of conflict between the two documents, these Candidate Terms prevail insofar as it concerns use by candidates.

Article 1 – Applicability

  1. These Candidate Terms apply to all candidates who use the platform.
  2. By registering, creating a profile, uploading a curriculum vitae, responding to jobs or using other features of the platform, the candidate declares to agree to these terms.
  3. 24werk.com reserves the right to amend these terms.

Article 2 – Purpose of the platform

1. 24werk.com offers candidates the possibility to:

  • create a profile
  • upload a curriculum vitae
  • view jobs
  • apply for jobs
  • get into contact with employers

2. 24werk.com solely facilitates contact between employers and candidates. 3. 24werk.com is not a party to employment contracts, assignments, secondment agreements or other agreements concluded between candidates and employers.

Article 3 – Registration

  1. For certain services a candidate must create an account.
  2. The candidate provides solely correct, complete and current information.
  3. The use of fictitious names, false identities or misleading data is not permitted.
  4. The candidate is responsible for keeping the data provided up to date.
  5. The candidate is responsible for all activities that take place via the account.

Article 4 – Login details

  1. Login details are personal and may not be provided to third parties.
  2. The candidate must take appropriate measures to prevent unauthorised use of the account.
  3. Suspicions of misuse or unauthorised access must be reported to 24werk.com immediately.

Article 5 – Candidate profile

1. Candidates can create and maintain a profile within the platform. 2. The profile may consist, among other things, of:

  • name
  • place of residence
  • work experience
  • education
  • certifications
  • skills
  • availability
  • curriculum vitae
  • other relevant information

3. The candidate guarantees that the information provided is correct, complete and current. 4. Including deliberately incorrect information is not permitted.

Article 6 – Curriculum Vitae

1. Candidates can upload a curriculum vitae. 2. The candidate remains responsible for the content of the curriculum vitae. 3. The curriculum vitae may not contain:

  • incorrect information
  • discriminatory content
  • offensive content
  • illegal content
  • copyright-protected content of third parties without permission

4. 24werk.com reserves the right to remove curricula vitae that conflict with these terms.

Article 7 – Applying

1. Candidates can respond to jobs published on the platform. 2. By applying, the candidate agrees that relevant data is shared with the employer concerned. 3. Employers are independently responsible for the processing of applications. 4. 24werk.com has no influence on:

  • invitations
  • rejections
  • interviews
  • selection procedures
  • employment conditions
  • recruitments

5. 24werk.com offers no guarantee of an invitation, interview or employment contract.

Article 8 – Visibility of data

  1. Candidates acknowledge that certain profile data may be visible to employers.
  2. Contact details may be made available to employers who use the services of 24werk.com for this.
  3. By using the platform, the candidate consents to the processing of data in accordance with the Privacy Statement.
  4. The candidate remains responsible for the data voluntarily included in the profile.

Article 9 – Approach by employers

1. Employers may approach candidates following:

  • an application
  • a candidate profile
  • purchased contact details. 2. 24werk.com has no influence on the content of communication between employers and candidates. 3. 24werk.com is not responsible for:
  • offers
  • employment conditions
  • negotiations
  • arrangements between parties

Article 10 – Accuracy of jobs

  1. Jobs are posted by employers.
  2. 24werk.com does not fully check jobs in advance for accuracy or completeness.
  3. Candidates remain responsible themselves for assessing employers and jobs.
  4. Candidates must carry out their own research before entering into agreements.

Article 11 – Prohibited use

Candidates are not permitted to:

  • provide incorrect information
  • use false identities
  • mislead third parties
  • send unsolicited messages
  • circumvent security measures
  • use automated systems
  • spread viruses or harmful software
  • use the platform for purposes other than work-related activities

Article 12 – Privacy and personal data

  1. Personal data is processed in accordance with the Privacy Statement of 24werk.com.
  2. Candidates are responsible for the personal data they publish themselves.
  3. Candidates must not publish personal data of third parties without permission.
  4. Employers who receive candidate data are independently responsible for its further processing.

Article 13 – Deletion of profiles

1. Candidates can request deletion of their account. 2. Deletion of an account does not automatically mean that all historical data is deleted immediately. 3. Certain data may be retained if this is:

  • legally required
  • necessary for security
  • necessary for dispute resolution
  • necessary for fraud prevention

4. The retention periods are set out in the Privacy Statement.

Article 14 – Intellectual property rights

  1. The candidate retains rights to their own curriculum vitae and other content.
  2. By uploading content, the candidate grants 24werk.com a non-exclusive right to process, publish and make available this content within the platform.
  3. The platform, the software, databases and design remain the property of 24werk.com.

Article 15 – Availability of the platform

  1. 24werk.com strives for a well-functioning platform.
  2. 24werk.com does not guarantee uninterrupted availability.
  3. Maintenance, updates and technical malfunctions may lead to temporary interruptions.
  4. Temporary unavailability gives no right to compensation.

Article 16 – Suspension and termination

1. 24werk.com may block or terminate accounts in the event of:

  • fraud
  • misuse
  • breach of these terms
  • breach of legislation
  • security risks

2. 24werk.com is not liable for the consequences of a justified block.

Article 17 – No guarantee of work

1. 24werk.com offers solely a digital platform. 2. 24werk.com does not guarantee:

  • work
  • assignments
  • interviews
  • responses from employers
  • recruitment
  • a certain number of application opportunities

3. Obtaining work remains dependent on factors over which 24werk.com has no influence.

Article 18 – Liability

1. 24werk.com is not liable for:

  • acts of employers
  • the content of jobs
  • rejections
  • decisions of employers
  • employment conflicts
  • indirect damage
  • consequential damage

2. Insofar as liability cannot be excluded by law, it is limited to the amount the candidate has paid for a service.

Article 19 – Indemnification

Candidates indemnify 24werk.com against claims of third parties arising from:

  • information provided
  • curriculum vitae
  • applications
  • infringement of rights of third parties
  • unlawful use of the platform

Article 20 – Force majeure

1. 24werk.com is not liable for shortcomings as a result of force majeure. 2. Force majeure includes, among other things:

  • internet outages
  • cyberattacks
  • power failures
  • malfunctions at suppliers
  • government measures
  • natural disasters
  • war
  • pandemics

Article 21 – Changes

  1. 24werk.com may amend these Candidate Terms.
  2. Amended terms are published on the platform.

3. Continued use of the platform counts as acceptance of the amended terms.

Article 22 – Applicable law and disputes

  1. These Candidate Terms are governed exclusively by Dutch law.
  2. Disputes are submitted to the competent court in the Netherlands.
  3. The parties will endeavour to resolve disputes by mutual consultation first.
