- 24werk.com may refuse registration if there is reasonable doubt about the legitimacy of an organisation.
Article 3 – Employer account
- Every employer is responsible for the use of the account.
- Login details must be treated confidentially.
- Sharing accounts with unauthorised third parties is not permitted.
- Employers are liable for all actions that take place via their account.
- Suspicions of unauthorised use must be reported to 24werk.com immediately.
Article 4 – Posting jobs
1. Employers may only post jobs for actually existing positions. 2. Jobs must:
- be correct
- be complete
- be up to date
- comply with the law
3. Jobs may not contain misleading information. 4. Jobs may only be posted on behalf of the organisation for which the employer is authorised to act. 5. Posting jobs with the sole purpose of collecting personal data is prohibited.
Article 5 – Prohibited jobs
It is not permitted to post jobs that:
- are discriminatory
- are offensive
- are misleading
- relate to illegal activities
- contain unrealistic employment conditions
- are solely intended for marketing purposes
- promote pyramid schemes
- relate to prohibited or punishable activities
24werk.com may remove such jobs without prior warning.
Article 6 – Applications
1. Employers receive applications directly via the platform. 2. Employers are responsible for:
- processing applications
- communication with candidates
- selection procedures
- employment conditions
- any recruitment
3. 24werk.com has no influence on how employers handle applications. 4. Employers must treat candidates respectfully and professionally.
Article 7 – Candidate database
1. 24werk.com offers employers access to available candidate profiles. 2. The visibility of data may depend on the chosen package or the purchased service. 3. Employers acknowledge that candidate data originates from the candidates themselves. 4. 24werk.com does not guarantee:
- the accuracy
- the completeness
- the timeliness
- the availability of candidates
5. Employers remain responsible for their own verification of candidates.
Article 8 – Purchase of candidate data
1. Employers can obtain access to candidates’ contact details for payment. 2. The purchase grants solely the right to use this data for recruitment purposes. 3. The purchase confers no ownership right to personal data. 4. Contact details may only be used for:
- application procedures
- recruitment and selection
- job placement
5. Any other form of use is prohibited.
Article 9 – Use of candidate data
Employers may not:
- sell candidate data
- rent it out
- make it public
- share it with unauthorised third parties
- use it for marketing
- use it for commercial acquisition
- export it to external databases without a valid basis
A breach may lead to immediate blocking of the account.
Article 10 – Privacy legislation
- Employers are independently responsible for compliance with the GDPR.
- Once personal data is received via the platform, the employer is responsible for its further processing.
- Employers must take appropriate technical and organisational measures to protect personal data.
- Employers may only process personal data for legitimate recruitment purposes.
- Employers indemnify 24werk.com against claims arising from their processing of personal data.
Article 11 – Anti-discrimination
1. Employers must comply with all applicable laws and regulations regarding equal treatment. 2. It is not permitted to exclude candidates on the grounds of:
- gender
- origin
- skin colour
- religion
- sexual orientation
- age
- disability
- nationality
- political conviction
- marital status; unless a legal exception applies
3. 24werk.com may remove discriminatory jobs.
Article 12 – Prohibited use of the platform
Employers may not:
- use automated scripts
- scrape CVs
- circumvent security measures
- harass candidates
- post fake jobs
- collect data outside the features offered
Article 13 – Payments
- Paid services are delivered in accordance with the Delivery Terms of 24werk.com.
- Invoices must be paid within the agreed period.
- In the event of non-payment, 24werk.com may limit or block access to services.
- Any collection costs are at the expense of the employer.
Article 14 – Intellectual property
- Employers retain rights to their own job texts.
- By posting a job, the employer grants 24werk.com a right of use to publish, promote and distribute this job within the platform.
3. The platform, the software and the databases remain the property of 24werk.com.
Article 15 – Availability
- 24werk.com strives for optimal availability of the platform.
- Maintenance work and malfunctions may lead to temporary interruptions.
- 24werk.com gives no guarantee of uninterrupted availability.
Article 16 – Termination of accounts
1. 24werk.com may block or terminate accounts in the event of:
- fraud
- misuse
- breach of these terms
- breach of legislation
- security risks
2. Services already paid for are not automatically refunded in such cases.
Article 17 – No guarantee of results
1. 24werk.com offers a digital platform for recruitment purposes. 2. 24werk.com does not guarantee:
- a certain number of applications
- a certain number of candidates
- successful placements
- successful recruitments
- responses from candidates
3. Results depend on factors over which 24werk.com has no influence.
Article 18 – Liability
1. 24werk.com is not liable for:
- decisions of candidates
- incorrect candidate information
- lost turnover
- missed opportunities
- indirect damage
2. Insofar as liability cannot be excluded by law, it is limited to the amount paid for the relevant service.
Article 19 – Indemnification
Employers indemnify 24werk.com against claims of third parties arising from:
- jobs
- application procedures
- processing of personal data
- breach of legislation
- employment law disputes
- unlawful acts of the employer
Article 20 – Applicable law
- These Employer Terms are governed exclusively by Dutch law.
- Disputes are submitted to the competent court in the Netherlands.
